Terms of Service

1. Who these terms are with
These Terms of Service ("Terms") are between you and Human Books (ABN 83 432 174 196) ("Human Books", "we", "us"). By creating an account, accepting an invite, or purchasing anything through humanbooks.com, you agree to these Terms and to our Privacy Policy.
2. Who can use Human Books
You must be 18 years or older to create an account or make a purchase. Co-creator contributors must also confirm they are 18 or older when accepting an invite (checked at acceptance).
This is a self-attestation, not age verification, consistent with how the contributor invite flow already works.
3. What Human Books is
Human Books turns your own answers into a written memoir, which you review and approve before it's finalised, and which you can order as a printed keepsake and/or read as a digital edition.
Our core commitment, and it's binding:
- We generate your book's chapters strictly from what you've told us. The system is not permitted to invent names, dates, events, places, or other details you haven't stated.
- Any gap in what you've told us stays a gap, or becomes a question back to you, never a guess.
- Every chapter is shown to you for review and requires your explicit approval before it's considered final.
4. Your account
- You're responsible for keeping your login credentials secure and for all activity under your account.
- One live account per email address.
- You must give us accurate information, and keep it up to date.
5. Licences, books, and gifting
- A purchase (a "licence") entitles you to write and complete one book. Writing another book requires another licence.
- A licence can be purchased as a gift for someone else: they own the resulting book, and it's separate from your own.
- You can export your answers and finished book, and delete your account and data, at any time (see the Privacy Policy for what "delete" actually means in terms of retention).
- Licences are personal to the recipient and are not transferable or resellable, except through the gifting mechanism built into the product.
6. Ownership of your book
Your story is yours.
- Whatever rights exist in the finished book (your original answers, and the AI-assisted prose generated from them) belong to you, the account holder. To the extent any rights in the generated text might belong to Human Books (a genuinely unsettled area of law for AI-assisted writing), we assign and waive them in your favour.
- You grant Human Books only the limited rights needed to produce, print, and deliver your book to you (and to anyone you explicitly choose to share it with), nothing more. We don't use your book content for marketing, don't publish it, and don't use it to train AI models, without your separate explicit permission.
- If your book includes a co-creator's contributed passage, that specific passage remains attributed to them under the terms in Section 7, but the finished book as a whole (compilation, design, your own chapters) is yours.
7. Co-creators / contributors
If you invite someone to contribute their own perspective to a chapter:
- Their contribution is a separate, credited passage in their own words, never merged into or presented as your own answers.
- You cannot edit their words. You may approve, reject with a reason, or remove their contribution entirely.
- Removing a contributor deletes their answers and passage for your book in one action.
- If a contributor later deletes their own Human Books account, any passage you've already approved stays in your book, credited by name. This is disclosed to them and requires their consent before they contribute.
- Contributors must confirm they're 18 or older to accept an invite (Section 2).
8. Pricing and payment
- Prices are shown to you at checkout, in the currency and amount displayed at that time. The price you're charged is the price shown to you at the moment of purchase.
- We may change prices for future purchases at any time; changes don't affect a purchase you've already made.
- Payment is processed by Stripe. We never see or store your full card details.
- Some plans include a number of complimentary printed copies as part of the licence. The exact allowance is shown to you at checkout and in your account, and governs over any other description.
- Prices are in the currency shown at checkout and include GST or other applicable taxes where they apply. Postage for printed copies is calculated separately when your book is assembled and sent to print (see Section 10).
9. Refunds
The full policy is on our Refund Policy page. In summary:
- Within 7 days of purchase, and before you've generated more than 2 chapter drafts: full refund on request.
- After 7 days, or once you've generated more than 2 chapter drafts (whichever comes first): no refund, but you keep full access to finish and use your book.
- Printed copies: see Section 10 for defects/damage and postage. Once a print job has been submitted to production, it can't be cancelled for a refund. Production begins immediately on submission.
- Share links: if a link you've sent or pre-paid for expires unclaimed, you receive account credit, never a cash refund. Resending generates a new link.
- Nothing in this section excludes or limits any consumer guarantee you're entitled to under the Australian Consumer Law, or an equivalent mandatory consumer protection law in your own country, that cannot be excluded by agreement. For customers in the EU/UK: digital content is generally exempt from the standard 14-day withdrawal right once you've expressly requested delivery to begin and acknowledged you lose that right by doing so, which is effectively what happens when you begin answering questions and generating a chapter; nothing here removes any right that can't lawfully be waived.
10. Printed copies
- Printed copies are produced print-on-demand after you approve and assemble your book. Production and delivery timeframes shown to you are estimates, not guarantees, and can be affected by factors outside our control.
- Postage: shipping and postage are calculated when your book is assembled and sent to print. The final cost depends on the finished book (including page count) and the delivery address. It is not fixed at the time you buy a licence or plan. We don't mark up postage — we charge you only what our print partner charges us for shipping that order. The amount shown at print checkout is what you pay for postage.
- If your printed copy arrives damaged, defective, or clearly not matching what you approved, contact us within 30 days of delivery and we'll arrange a reprint at no cost to you. We don't offer cash refunds on defective prints, only replacement, because the correct fix for a printing fault is a corrected print, not a refund of a book you're still entitled to receive.
- Shipping address accuracy is your responsibility. We validate the address before charging, but we're not responsible for delivery failure caused by an incorrect address you supplied.
11. Digital edition
Where purchased or included, the digital edition gives you in-browser reading access to your finished book (the preferred way to read). After you approve and send your book to print, you may also download the interior PDF from Account → Your data. Access is tied to your account and entitlement.
12. Acceptable use
You agree not to:
- Use Human Books to create or store content that is illegal, defamatory, harassing, or that infringes someone else's rights.
- Impersonate another person, or misuse the co-creator invite or share-link systems to contact people who haven't agreed to be contacted.
- Attempt to reverse-engineer, scrape, or interfere with the service.
- Abuse the in-app bug reporter (spam, malicious attachments, or flooding) — we rate-limit reports and may ignore or delete abusive submissions.
- Write about an identifiable third party in a way that violates their legal rights (see Section 13).
13. Content about other people
Because a memoir often describes real people (family, friends, and others) who haven't themselves agreed to Human Books' terms:
- You're responsible for what you choose to write about other people, and you confirm you have the right to write about them in the way you have.
- You agree to indemnify Human Books against claims a third party brings against us arising from content you wrote about them (defamation, privacy, etc.). This doesn't apply to content our own systems generate that goes beyond what you actually said (that's on us, and shouldn't happen given Section 3's grounding commitment).
- Co-creator contributions are covered by the same principle, applied to the contributor for their own words.
14. Suspension and termination
- You can delete your account at any time (see Privacy Policy).
- We may suspend or terminate your account if you materially breach these Terms, including fraud, abuse of the invite/share-link system, or illegal content, after reasonable notice where practical. We won't do this to avoid honouring a purchase you've already made.
15. Disclaimers and limitation of liability
- The service is provided "as is." We don't guarantee uninterrupted availability, and generated content reflects our best-effort grounding in your answers. You're responsible for reviewing and approving each chapter before it's finalised.
- To the maximum extent permitted by law, Human Books' total liability to you for any claim arising from these Terms or the service is limited to the amount you paid for the specific order or purchase giving rise to the claim.
- We're not liable for indirect, incidental, or consequential loss.
- Nothing in this section excludes or limits liability that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law, or liability for death or personal injury caused by our negligence.
16. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia. If a dispute arises, we'd like the chance to sort it out directly first. Contact us before pursuing anything formal. Subject to that, the courts of Queensland, Australia have non-exclusive jurisdiction.
17. Changes to these Terms
We'll update the "last updated" date for any change, and notify account holders by email for material changes.
